Terms of Service

This Terms of Service Agreement (“Agreement”) is a legal agreement between you (“User,” “You”) and Rahul Chowdhury (“we,” “us,” or “our”) governing your use of the Ducat mobile application and related services (the “App” or “Service”).

By downloading, subscribing to, or using Ducat, You agree to be bound by this Agreement.

If You do not agree, do not use the App.

1. Service Overview

Ducat is a subscription-based personal finance app.

The App provides tools for:

• Recording and analysing transactions
• Processing queries using AI services
• Syncing your data privately through iCloud

Ducat is provided as a service, not a one-time software purchase.

2. Account

To use Ducat, you must create a user account and sign in using Sign in with Apple.

You agree to:

• Provide accurate account information
• Maintain the security of your device and Apple account
• Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms.

3. Subscriptions and Trial

Ducat requires an active subscription purchased through Apple’s App Store.

• New subscriptions may include a 14-day free trial
• After the trial, your subscription automatically renews unless cancelled
• Billing and renewals are handled entirely by Apple
• Pricing and refund policies are governed by Apple Media Services Terms

We do not process or store your payment information.

4. License to Use the App

Subject to an active subscription and compliance with this Agreement, we grant you a:

• Personal
• Non-exclusive
• Non-transferable
• Revocable

License to use Ducat for your own, non-commercial purposes.

The App is licensed, not sold.

5. Fair Use and Service Limits

We do not impose fixed limits on the number of transactions or queries you can process using the App.

However, to maintain service reliability and prevent abuse, we reserve the right to apply reasonable fair-use limits, including:

• Rate limiting excessive requests
• Temporarily restricting automated or abusive usage
• Suspending accounts involved in fraud, scraping, or misuse

These limits are designed to protect the service for all users.

6. Restrictions

You may not, and agree not to:

• Resell, rent, or commercially exploit the App or Service
• Reverse-engineer, decompile, or modify the App or Service
• Attempt to bypass subscription checks or service limits
• Use automated scripts or bots to abuse the Service
• Interfere with servers or infrastructure
• Use the App in violation of any applicable law

7. Ownership

All rights, title, and interest in Ducat, including software, design, branding, and intellectual property, remain the exclusive property of the Licensor (Rahul Chowdhury).

This Agreement does not transfer ownership to you.

8. Third-Party Services

Ducat relies on third-party services, including but not limited to:

• Apple (App Store, subscriptions, iCloud)
• OpenAI (AI processing)
• Sentry (crash reporting)

We are not responsible for the availability, security, or practices of third-party services.

Your use of those services may be subject to their terms and policies.

9. Modifications and Updates

We may:

• Update or improve the App
• Add or remove features
• Modify or discontinue parts of the Service

Updates may be required to continue using Ducat.

We are not obligated to maintain specific features indefinitely.

10. Termination

This Agreement remains in effect until terminated.

You may terminate by:

• Cancelling your subscription
• Uninstalling the App

We may suspend or terminate access if you violate these Terms or misuse the Service.

11. Warranty Disclaimer

THE APP AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Uninterrupted or error-free operation
• Continuous availability of the Service

We do not guarantee that the Service will always be available, secure, or free from defects.

The Service may experience downtime, delays, maintenance interruptions, or outages due to technical issues, updates, or third-party providers. We are not responsible for any loss or damage resulting from such interruptions.

12. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount you paid in the preceding 12 months
• We are not liable for indirect, incidental, or consequential damages, including loss of data, profits, or business interruption

13. Indemnification

You agree to indemnify and hold us harmless from claims or damages arising from:

• Your use of the App
• Violation of these Terms
• Violation of any law or third-party rights

14. Governing Law

This Agreement is governed by the laws of India, excluding conflict of law rules.
Any disputes shall be resolved exclusively in courts located in India.

15. Changes to These Terms

We may update these Terms from time to time.

The latest version will always be available on our website. Continued use of Ducat after changes constitutes acceptance of the updated Terms.
